Acceptable use
This policy forms part of our terms of Portfolio website use (Terms and Conditions) and applies in addition to them.
1. Lawful and prohibited uses
1.1 You may use our site only for lawful purposes. You may not use it:
(a) in any way that breaches any applicable local, national or international law or regulation;
(b) in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
(c) for the purpose of harming or encouraging others to harm minors in any way;
(d) to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards set out in paragraph 3 below;
(e) to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam);
(f) to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
1.2 You also agree not to interfere with, damage or disrupt:
(a) any part of our site;
(b) any equipment or network on which our site is stored;
(c) any software used in the provision of our site; or
(d) any equipment or network or software owned or used by any third party.
2. Interactive Services
2.1 We may from time to time provide interactive services on our site, including, without limitation:
(a) facilities for you to upload materials to parts of our website;
(b) areas where you can comment on our website or make enquiries about our courses and other services; and
(c) areas where you can chat online to one of our helpdesk staff.
2.2 Where we do provide any interactive service, we will provide clear information to you about the kind of service offered, whether it is moderated and what form of moderation is used (including whether it is human or technical).
2.3 We will assess any perceived risks for users (and in particular, for children) when they use any interactive service provided on our site and we will decide whether it is appropriate to moderate the relevant service and (where relevant) what kind of moderation to use in the light of those risks. However, you acknowledge that moderation is not fool proof and we expressly exclude our liability for any loss or damage arising from the use of any interactive service by a user in contravention of any guidance we make available or our content standards, whether the service is moderated or not.
2.4 We advise parents whose children have access to any of our interactive services to discuss with their children the importance of online safety and to be aware of the potential risks to them.
2.5 Where we do moderate an interactive service, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.
3. Content standards
3.1 These content standards apply to any and all material which you contribute to our site (contributions), and to any interactive services associated with it.
3.2 Contributions must:
(a) be accurate (where they state facts);
(b) comply with applicable law in the UK and in any country from which they are posted.
3.3 Contributions must not:
(a) contain any material which is defamatory of any person;
(b) be threatening, bullying or abusive, invasive of another’s privacy or be likely to cause annoyance, embarrassment, alarm, inconvenience or needless anxiety;
(c) contain any material which is obscene, offensive, hateful or inflammatory;
(d) promote sexual services, sexually explicit material or violence, present minors in a sexual way;
(e) promote self-harm, eating disorders or hard drug abuse;
(f) include or promote hate speech or crime;
(g) be gratuitously violent or gory;
(h) contain any personal information belonging to or relating to any other person or request personal information from a minor;
(i) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
(j) infringe any copyright, database right or trade mark;
(k) be likely to deceive any person;
(l) be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
(m) promote or encourage any illegal activity;
(n) be used to misrepresent your identity;
(o) give the impression that they emanate from us or any other third party, if untrue;
(p) promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
3.4 Opinions stated in any contributions must be genuinely held.
4. Suspension of access
4.1 We will determine, in our discretion, whether there has been a breach of this policy and may take such action as we deem appropriate.
4.2 Failure to comply with this acceptable use policy may result in our taking all or any of the following actions without further notice:
(a) temporary or permanent withdrawal of access to our site;
(b) temporary or permanent removal of any posting or material uploaded by you to our site;
(c) issue of a warning to you;
(d) commencement of legal proceedings against you, including for reimbursement of all losses we suffer as a result of your breach;
(e) disclosure of such information to law enforcement authorities as we deem necessary;
(f) any other action we consider reasonable in the circumstances.
4.3 We exclude liability for actions taken in response to breaches of this policy.
